Waivers - Working with Embassies

In some cases, an immigrant who enters the country without inspection and established residence after finding employment or having a family will apply for a green card. Once the United States Citizenship and Immigration Services (USCIS) discovers he or she has been in the country illegally, he will be placed in removal proceedings. In these situations, we are typically able to avoid deportation and are able to secure voluntary departure for these individuals. Simultaneously, we proactively work with our clients on the process of bringing them back into the United States through a waiver once they return to their home country. A waiver may be granted by working through the US embassy and the foreign office of USCIS in the client's home country. Rogers & Rogers, PC works aggressively to minimize the amount of time our client's spend outside the country by proactively initiating waiver matters early in the process and working to keep our clients in the country as long as possible before they must return home. In other cases, waivers may also be available even if an immigrant is deported and has a criminal history in the United States or in his home country.

In cases involving visa applications, the process may be delayed, requiring the intervention of the immigrant's home consulate. Our office can facilitate the approval process by working through the US State Department, the US embassy in the country in question, and the foreign consulate itself.
